Marks and Spencer has been forced to change the way it enlists customers to its new "&more" credit card just days after its launch.

M&S told existing Chargecard holders that they would be automatically changed over to its new "&more" credit and loyalty card unless they objected.

However, the Office of Fair Trading said this was illegal since the company had signed consumers up to the scheme without their consent - a breach of the Consumer Credit Act 1974.

M&S said that all store cardholders being sent the new "&more" card would now be told, that if they wish to keep their store card, they need take no action.

If they wish to replace the store card with the new credit card, consumers must take positive action to activate it.
