Stephen Robertson, director general of the British Retail Consortium, correctly points out that the Competition Commission had access to the full facts and documents.

However, while approvingly and again correctly quoting our conclusion that the industry is delivering a good deal for customers, he neglected to refer to another of our findings, that "some aspects of the way retailers deal with their suppliers could, if left unchecked, also harm consumers". This is a relevant point to the ombudsman debate and the need for rigorous enforcement of the new code.

Incidentally, it is curious that while only a few weeks ago the BRC was saying the ombudsman could cause a 0.1% increase in prices, in this letter the figure now appears to have risen to 2% or 3%.
