A new tobacco company in Scotland has attracted the attention of cigarette giant Imperial Tobacco - amid concerns over a potential trademark infringement.

The new company, Emperial Tobacco, recently registered two trademarks with the Intellectual Property Office for Hufers rolling tobacco and Hufers cigarettes.

Emperial Tobacco filed a certificate of incorporation at Companies House on 14 September and is registered to an address in Glasgow. There is also a website - www.emperialtobaccogroup.com - although so far the page simply reads: “Emperial Tobacco - new website coming soon”.

“We are aware of the situation and our legal team will be contacting the company concerned very shortly,” said head of UK corporate and legal affairs Colin Wragg.

Imperial was likely to start with a cease and desist letter which could lead to court proceeding seeking an injunction to stop it trading, said Addleshaw Goddard IP specialist Emma Armitage. Or it could seek to have the website transferred to Imperial.
