An MP is calling for a ban on Kinder Surprise and has taken his fight over toys in food to Europe.

Stroud MP David Drew has urged the government to ban foods containing inedible items because of the potential choking hazard. Drew singled out Kinder Surprise manufacturer Ferrero and said the UK needed a ban similar to that in the US where the Consumer Product Safety Commission has banned non-food items from being put in food. "It's straightforward," he said. "We have taken it to the British government and they said it will have to go to Europe."

However, Ferrero said that as the toys are in capsules, they were not part of the food. David Connal, general affairs manager for Ferrero UK, said: "The European Commission and governmental bodies in the EU have found no evidence that toys marketed like Kinder Surprise pose any greater risk to children than other toys with small parts."
